A. Definitions

- The Customer: The individual, company, or organisation purchasing goods or services from “The Company,” as indicated within the customer section of all Company sales order/ecommerce/invoice documentation.
B. Overview Of Terms & Conditions
These terms and conditions (last updated [Month Year]) apply to the sale and supply of fencing, garden products, accessories, and related services by “The Company” to “The Customer.”
“The Company” adheres to the Consumer Rights Act 2015 and Consumer Contracts Regulations 2014 (ICACS). Any order placed by “The Customer,” whether in person, by telephone, by mail, or online, forms a legally binding contract of sale. The terms below are intended to protect both “The Customer” and “The Company.”
1. Retention of Title/Ownership
1.1 Legal ownership of any goods supplied remains with “The Company” until full payment has been received from “The Customer.”
1.2 If “The Customer” obtains goods without full payment, “The Company” retains the right to demand settlement of all outstanding monies prior to transfer of ownership or reclaim the goods. The condition of goods prior to reclamation is the sole responsibility of “The Customer.”
2. Prices
2.1 All prices displayed on “The Company” website and literature are in Pounds Sterling (£) and inclusive of VAT.
2.2 For orders outside the specified delivery areas, “The Customer” may contact “The Company” for potential delivery options, subject to additional charges if applicable.
2.3 Prices are reviewed monthly. Changes due to material costs, manufacturer price changes, or promotions may be applied without notice.
2.4 A 20% restocking fee applies for returned items in saleable condition, excluding custom and made-to-measure products.
3. Payment
3.1 Full payment is required at the time of order placement.
3.2 Payments are accepted in Pounds Sterling (£) via BACS, Visa, MasterCard, and other major credit/debit cards.
3.3 Orders will not be processed until cheque payments have cleared, if applicable.
3.4 “The Company” reserves the right to require additional identification for high-risk orders. If proof is not provided, the order may be canceled and refunded.
4. Delivery
4.1 Delivery Areas: “The Company” delivers only within the designated areas specified on the delivery policy page. Outside these areas, delivery may be considered on a case-by-case basis and may incur additional fees.
4.2 Delivery Method: Deliveries are kerbside only. Our delivery drivers are not insured to enter customer properties, and if delivered by Hiab crane, the nearest accessible point will be used.
4.3 Timing: Delivery times are estimated and subject to availability. Changes in estimated delivery times may occur without notice.
4.4 Customer Responsibility: “The Customer” is responsible for providing clear and unobstructed access for delivery. If access is blocked or there is a failed delivery due to lack of access, additional charges may apply.
4.5 Once goods are delivered and unloaded, responsibility passes to “The Customer.”
5. Returns & Cancellations
5.1 Standard Returns: “The Customer” has a 14-day right to return non-custom products under UK consumer law, provided items are in saleable condition.
5.2 Non-Returnable Products: Custom-made items (e.g., bespoke gates) and concrete products are non-returnable unless defective. Returns on these items will be considered on a case-by-case basis.
5.3 A restocking fee of 20% applies to unwanted returns that are in saleable condition.
6. Privacy
6.1 Data Protection: “The Company” is committed to customer privacy and complies with the Data Protection Act 1998.
6.2 Customer details provided at checkout (such as name, address, and contact information) will only be used to facilitate order delivery and communication. We will never sell or share your personal data with third parties.
6.3 Subscribers to “The Company” newsletter can opt out at any time.
7. Security
7.1 To ensure customer data security, “The Company” website operates on a secure server.
7.2 Customer data entered during checkout will be stored and encrypted following current data protection standards.
8. Complaints
8.1 For any complaint, please initially contact “The Company” by telephone at 01953 483719. A follow-up written complaint may be sent via email to [Your email here] or by letter to “The Company” address.
8.2 All complaints will be addressed promptly and fairly to reach a resolution.
9. Miscellaneous
9.1 Order Amendments: Changes to orders are accepted up to the point of dispatch. After dispatch, changes may not be possible.
9.2 Product Condition: Products may vary due to the natural characteristics of timber. “The Company” cannot accept claims due to natural adjustments such as warping, twisting, or splitting.
9.3 Images on “The Company” website are for illustrative purposes only and may not fully represent the product.
10. Law
10.1 These terms and conditions are governed by UK law.
10.2 All transactions with “The Company” are subject to these terms and conditions.
11. Collection
11.1 Orders placed online for collection require photo ID and the payment card used at purchase.
